Welcome to TopFreePrompts.com, operated by LucyBrain AI Research ("LucyBrain," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website located at TopFreePrompts.com and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

"Service" refers to TopFreePrompts.com and all related services provided by LucyBrain
"Content" includes all prompts, text, graphics, images, and other materials on the Service
"User" or "you" refers to any individual or entity using the Service
"Account" refers to your registered user account with the Service
3. Eligibility and Account Registration

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3.2 Account Creation
To access premium features, you must create an account by providing:

Account password
Any additional information required for your chosen subscription plan

All activities that occur under your account
Notifying us immediately of any unauthorized access

4. Service Plans and Subscriptions
4.1 Service Tiers
We offer multiple service tiers:

Premium Subscriptions: Full access to our prompt library and advanced features
Business Plans: Enhanced features for commercial use
4.2 Subscription Terms
Subscriptions automatically renew unless cancelled
You may cancel your subscription at any time. To cancel your subscription, you must send a written request to hello@lucybrain.com.
All member cancellations must be submitted in writing to hello@lucybrain.com. To avoid renewal for the next billing cycle, cancellation requests must be received at least 7 days before the next billing date. Monthly subscriptions will remain active until the end of the current billing period. Annual subscriptions will not be partially refunded.
All sales are final - no refunds on digital products or annual subscriptions
Price changes will be communicated with advance notice
4.3 Payment and Refund Policy
NO REFUNDS POLICY:
All sales are final upon purchase confirmation and digital access provision
Digital products are non-refundable once access is granted to your account
Annual subscriptions cannot be canceled for partial refunds under any circumstances
Immediate digital access constitutes complete product delivery and fulfillment
Customer acknowledges that receipt of digital access constitutes full delivery of purchased services
No exceptions will be made to this policy regardless of usage, satisfaction, or circumstances
Lifetime Access is non-refundable under any circumstances, including change of mind, accidental purchase, or dissatisfaction.
Payment Terms:
Payments are processed through secure third-party payment processors
All fees are non-refundable as expressly stated above
You authorize us to charge your payment method for applicable fees
4.4 Lifetime Access
One-time payment granting perpetual access to all current and future prompts and features.
Support and product updates included for the first 12 months after purchase. Beyond this period, support and updates are not guaranteed, but content remains accessible.
Lifetime Access is non-refundable.
All purchases are governed by the LucyBrain License Agreement, which details permitted usage, restrictions, ownership, support, and updates. By purchasing, you agree to comply with its terms.
5. AI Technology Limitations and User Responsibilities
5.1 AI Service Limitations
Technology Disclaimer:
Results may vary significantly based on product complexity, description quality, and specific use case requirements
No guarantee of specific outcomes: We do not warrant particular quality levels, commercial viability, or fitness for specific purposes
Complex designs may require additional editing or alternative approaches beyond our provided prompts
Customer solely responsible for evaluating suitability of generated content for their specific business needs
No guarantee of commercial success or revenue generation from using our prompts or generated content
Product-Specific Limitations:
Complex jewelry, intricate patterns, and highly detailed designs may not reproduce accurately
Technical garments and specialized products may require professional photography alternatives
Brand logos, specific typography, and copyrighted elements cannot be reliably generated
Customer acknowledges these limitations and accepts responsibility for determining product suitability
Customer solely responsible for determining commercial viability and legal compliance of generated materials.
5.2 User Evaluation Responsibility
By purchasing our Service, you acknowledge:
Pre-purchase evaluation: You have reviewed our capability examples and understand service limitations
Suitability assessment: You are responsible for determining if our Service meets your specific needs
Alternative solutions: For incompatible use cases, you will seek appropriate alternative solutions
No recourse for limitations: Service limitations do not constitute grounds for refunds or service credits
6. Acceptable Use
6.1 Permitted Use
You may use our Service to:
Access and use AI prompts for legitimate personal or business purposes
Create content using our prompts with proper attribution when required
Share results generated from our prompts (subject to restrictions below)
6.2 Commercial Use
Premium subscribers may use our prompts for commercial purposes, including:

6.3 Prohibited Activities
You agree not to:

Technical Restrictions:

Interfere with other users' access to or use of the Service
Legal and Ethical Restrictions:

Violation of these restrictions may result in immediate account termination and legal action, including claims for damages, injunctive relief, and attorney fees.
7. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by LucyBrain and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Prompt Usage Rights
Subscribers rights:
Commercial usage rights for all prompts
Right to use generated content for personal and business purposes
License to modify prompts for specific use cases
No redistribution or resale rights
Redistribution, resale, sublicensing, or inclusion of prompts in competing prompt libraries is strictly prohibited and constitutes a breach of these Terms.
7.3 User-Generated Content
When you submit content to our Service:
You retain ownership of your original content
You grant us a license to use, display, and improve our Service
You represent that you have the right to grant such license
7.4 Trademark Rights
"LucyBrain," "TopFreePrompts," and related marks are trademarks of LucyBrain. You may not use our trademarks without prior written consent.
8. AI Services and Third-Party Integration
8.1 Third-Party AI Platforms
Our prompts are designed for use with various AI services (ChatGPT, Claude, Midjourney, Google Imagen, etc.). We do not:
Control or guarantee the performance of third-party AI services
Warrant the results generated by third-party platforms using our prompts
Accept responsibility for third-party service availability or functionality
Provide technical support for third-party AI platforms
8.2 Output Responsibility
You are solely responsible for:
Content generated using our prompts on third-party platforms
Ensuring compliance with third-party service terms
Verifying accuracy and appropriateness of generated content
Any consequences of using generated content
Determining commercial viability and legal compliance of generated materials
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Content Moderation and Enforcement

Damages exceeding the amount paid for the Service in the preceding 12 months
Issues arising from third-party AI service usage
Dissatisfaction with generated content quality or commercial viability
12. Indemnification
You agree to indemnify and hold harmless LucyBrain from claims, damages, and expenses arising from:
Your use of the Service
Violation of these Terms
Infringement of third-party rights
Content you create or distribute using our prompts
Commercial use of generated content
13. Termination
13.1 Termination by You
You may terminate your monthly subscription at any time by submitting a written cancellation request to hello@lucybrain.com. Paid fees for the current billing period are non-refundable. Monthly subscriptions remain active until the end of the current billing cycle. Annual subscriptions are non-refundable.
Lifetime Access purchasers retain perpetual access to content even after termination of their account, but support and updates beyond 12 months are not guaranteed.
Monthly subscriptions will remain active until the end of the current billing cycle.
13.2 Termination by Us
We may terminate or suspend your access for:
Violation of these Terms
Non-payment of fees
Extended periods of inactivity
Legal or regulatory requirements
Requests for refunds contrary to our stated policy
13.3 Effect of Termination
Upon termination:
Your right to access the Service ceases immediately
We may delete your account and associated data
Outstanding fees remain due and payable
No refunds will be provided for remaining subscription periods
Survival clauses of these Terms remain in effect
14. Changes to Terms
We reserve the right to modify these Terms at our sole discretion. We will:
